1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded between PDM Parthian Distributer & Marketing Adviser GmbH (hereinafter “we” or “Supermunchies.de”) and our customers (hereinafter “customer” or “you”) via the website  www.supermunchies.de  .

1. Contractual partner

1. Conclusion of contract

The presentation of the products on our website does not constitute a binding offer. Only when the customer places an order does the customer make a binding offer to purchase the selected products. We immediately confirm receipt of the order with an automatic order confirmation via email. This order confirmation does not constitute acceptance of the offer. The contract is only concluded when we accept the order with a separate order confirmation or by delivering the goods.

1. Prices and payment

All prices quoted include VAT. Shipping costs are listed separately during the ordering process. Payment is made using the payment methods we offer, such as credit card, PayPal, or instant bank transfer.

1. Delivery and shipping

Delivery will be made to the delivery address provided by the customer. We strive for prompt delivery, however, we cannot accept liability for delays caused by third parties or unforeseen events. If a product is unavailable, we will notify the customer immediately and, if necessary, cancel the contract.

1. Right of withdrawal and return of food

The customer has the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period shall be 14 days from the day on which the customer or a third party designated by the customer takes possession of the goods.

Important NOTE:

For hygiene and health reasons, food that is sealed after delivery or packaged in a way that precludes opening or return for hygiene reasons is excluded from the right of withdrawal and exchange. This applies in particular to all fresh and perishable goods.

If you have purchased food products that are not sealed or delivered in a form that does not preclude withdrawal, you can exercise your right of withdrawal.

1. Retention of title

The delivered goods remain the property of Supermunchies.de until the purchase price has been paid in full.

1. Liability for defects and warranty

The statutory warranty rights apply. In the event of defects in the delivered goods, the customer has the right to subsequent performance (repair or replacement). If subsequent performance fails, the customer can withdraw from the contract or reduce the purchase price.

1. Liability

We are not liable for damages resulting from improper handling or use of the products. Our liability is limited to intent and gross negligence in accordance with statutory provisions.

1. Data protection

The protection of your personal data is important to us. Information on the collection, processing, and use of your data can be found in our privacy policy.

1. Final provisions

German law applies. The application of the UN Convention on Contracts for the International Sale of Goods is excluded. If the customer is a merchant, the place of jurisdiction is the registered office of Supermunchies.de.

Cancellation policy:

Right of withdrawal: You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period shall be 14 days from the day on which you or a third party designated by you takes possession of the goods.

Exception for food: Please note that food is excluded from the right of withdrawal for hygiene reasons if the goods have been sealed or otherwise rendered unusable to prevent return for health reasons.

To exercise your right of withdrawal, you must inform us (Supermunchies.de, PDM Parthian Distributer & Marketing Adviser GmbH, Wichmannstr. 4 / Haus 10 south, info@pdm-adviser.com) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail). Consequences of withdrawal: If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within 14 days from the day on which we received notification of your withdrawal from this contract. We will use the same means of payment for this refund that you used for the original transaction.
